Lasting power of attorney preparation, Liverpool and Wirral

The first form of LPA covers welfare - the daily routine, care homes, medical care and treatment of the individual concerned.

The second form covers finance - it allows the attorneys you appoint to collect and spend your money, sell your home and manage your bank accounts amongst other things.

Both of these documents come into play when an individual can no longer make decisions for themselves and needs another person to do so on their behalf.

A lasting power of attorney allows you, the client, to appoint or person (referred to as an attorney) or people to make important decisions for you.

The documents can be completed at any time but need to be registered with the Office of the Public Guardian in order to be effective.

What is a lasting power of attorney?

A Lasting Power of Attorney or LPA is document that allows a person or people you nominate to look after your affairs when you cannot. There are two types, one that deals with property and finance and one for your health.

Do I really need to put an LPA in place?

The simple answer is no. If you lose capacity to make decisions, your family members can apply to the Court of Protection to manage your affairs on your behalf. That said, this takes considerably longer and is significantly more costly. It is a matter of whether or not you want to get it ready, just in case to minimise the impact upon your loved ones.

How much does it cost for you to draft a lasting power of attorney?

A single LPA will cost £100. Two LPAs, however (two separate documents) will cost £150. To mirror a single LPA costs £150 (two documents) while to mirror two LPAs costs £250 (four documents).

Can you visit me at my home or workplace?

Yes, absolutely. Our meetings can take place at your home or your workplace, whichever works best for you. A travelling fee may apply depending upon your location.

When is a lasting power of attorney valid?

An LPA only becomes valid once the forms have been signed, witnessed correctly and lodged with the Office of the Public Guardian.

How complicated is the process?

Not very. We will have a meeting (either face to face, by phone or video) to discuss your needs. The documents will be prepared as a draft for your approval, before a final document is prepared.

Can people (my attorney or attorneys) take my assets?

Yes, in accordance with the law and the parameters of the LPA.

How long does a lasting power of attorney last?

An LPA will remain in place from registration until you pass away, unless you revoke it while you have capacity.

Who keeps hold of LPAs?

Either yourself as donor, or with the attorney or attorneys for when they need to use it.
